Successfully register your Energy Saving Plan GO 40166

With the start of the electricity crisis in Venezuela in 2009, the government has implemented measures focused on users developing their Energy Saving Plan aimed at progressively reducing their consumption. These, over the years, have shown an evolution towards a modernization that aims at the evaluation of strategies that allow effective compliance with the resolutions.

The latest resolutions on energy saving issued by the Ministry of Popular Power for Electric Energy are reflected in Official Gazettes 40166 and 40200. In 40166 the following is stated:

Article 1: The following users will be obliged to register and provide the information corresponding to the Plan for the Rational and Efficient Use of Electricity in the CORPOELEC portal:

a) Those with a demand greater than 2 megawatts (2MW).

b) Users exempted from compliance with the energy saving goals set forth in Resolution No. 76 dated June 10, 2011, published in the Official Gazette 39694 dated June 13, 2011, which are:

  • Medical care, sanitation and hygiene services.
  • Production and distribution of drinking water.
  • Production and distribution of hydrocarbons and their derivatives, gas and other fuels.
  • Citizen security, police forces and civil protection.
  • Collection and treatment of solid waste.
  • Land, air and sea public transport, as well as air traffic control.
  • Telecommunications service.
  • News, press, radio and television services.
  • Education: colleges and universities.
  • Land traffic control systems: traffic lights
  • Food safety.
  • Embassies and diplomatic headquarters.
  • All those additional cases that the MPPEE deems necessary to include.

In addition, industrial users who wish to establish their savings goals based on consumption rates in accordance with article 4 of Resolution No. 76 mentioned above.

c) All the bodies and entities of the Public Administration, through the energy management units provided for in Resolution No. 77 dated June 10, 2011 published in the Official Gazette No. 39694 dated June 13, 2011. 2011.

Article 2: The provision of information provided for in the previous article must be carried out within a period of thirty (30) business days from the publication in the Official Gazette of the Bolivarian Republic of Venezuela of this resolution.

Article 3: Failure to comply with the obligations established in Article 1 of this resolution will give rise to the following sanctions:

  • Those provided for in article 103 of the Organic Law of the Electric System and Service, for the users indicated in literal “a” of Article 1 of this resolution (Users with demands greater than 2 MW). That is, fines from 5 UT to 500 UT.
  • The tariff surcharges provided for in Resolution No. 76 dated June 10, 2011, published in the Official Gazette No. 39694 dated June 13, 2011, for users indicated in literal “b” of Article 1 of the present resolution (users exempt from the application of energy saving goals). That is, 10% on the bill for the corresponding month and an additional 5% for each recurrence.
  • The referral of the non-compliance file to the Comptroller General of the Republic for the purpose of it initiating the relevant Responsibility Determination procedure, for the users indicated in subparagraph “c” of Article 1 of this Resolution.

Article 4: The MPPEE may carry out the inspections and audits that may be necessary in order to determine compliance with the Plans for the Rational and Efficient Use of Electric Power, and open sanctioning procedures in case of non-compliance.

Resolution No. 24 of the MPPEE published in the Official Gazette 40200 establishes that an extension of forty-five (45) business days is granted, counted from June 27, 2013, for the registration of the Plan for the Rational and Efficient Use of Electric Power to users who have not done so. This is until September 2, 2013.

Registration in the CORPOELEC Portal

The Registration of the Plan for the Rational and Efficient Use of Electricity (UREE) in the CORPOELEC portal must be carried out following the guidelines set out in the following link: click .

It is important to note that the portal should include energy saving measures by type of equipment associated with your company, so registering a consumption reduction strategy without a criterion that determines both its TECHNICAL and ECONOMIC FEASIBILITY can mean a error whose cost is very high, remembering that in Article 4 (GO 40166), CORPOELEC is empowered to carry out inspections and verify compliance with what is registered in the UREE Plan.
